More than 300,000 veterans are suing 3M for defective earplugs in the 3M earplug lawsuit, which is a product liability claim in the form of a class-action lawsuit. Blasts, small-arms fire, IEDs, artillery fire, and other sources of high-intensity noise induce hearing loss in veterans. It also lads to conditions like post-traumatic stress disorder and traumatic brain injury.
In order to address this major risk, the US military decided to provide veterans with protective earplugs. Aearo Technologies, LLC's earplugs were so popular that they got an exclusive military contract to design the Combat Arms version 2 (CAEv2) earplugs for the US military. In 2007, 3M entered into a definitive agreement for the acquisition of Aearo.
Moldex-Metric Inc. filed a whistleblower claim against 3M Combat Earplugs, which changed the company's fate. A whistleblower action was filed by Moldex, a maker of respiratory and hearing protection products.
The following are the arguments presented in the Moldex whistleblower action against defective 3M earplugs:
• 3M lied to the federal authorities about the safety of its earplugs.
• Users were not informed of design flaws by 3M.
• Employees at 3M were aware of the defect.
• The veterans' hearing loss and ear injuries were not protected by 3M earplugs.
• To ensure product efficiency, 3M depended on faulty testing methodologies.
• 3M's advertised noise reduction rating was incorrect.
To settle the dispute, 3M agreed to pay $9,100,000. The Judicial Panel on Multidistrict Litigation centralized and moved the 3M Combat Arms Earplug Products Liability Litigation, MDL No. 2885, to the United States District Court due to an increase in the number of complaints filed against 3M for defective earplugs. Out of the sixteen bellwether trials in the 3M earplug lawsuit, ten trials were in favor of the plaintiffs, and six were in favor of the defendant. Damages include pain and suffering, loss of income, loss of consortium etc. 1000 3M earplug lawsuits are scheduled to go to trial in 2022. The MDL is expected to reach a global settlement in a few of years, with the plaintiffs and the defense agreeing to a settlement. After that, depending on whether each plaintiff agrees to the global settlement, the action may proceed as individual claims.
