Contractors Take Note - The EPA's New'Renovation

 As a result, the builder may incur greater exposure to lead-based paint asserts, which is excluded under most General liability coverages.The RRP Rule is a national EPA program which affects contractors, property managers, and many others who disturb qualifying exterior and interior painted surfaces. Remodeling, upkeep, painting/surface preparation, window replacement, electric, plumbing, and carpentry activities are subject to the application rules. Exceptions include emergency repair work, minor repair job that disturbs less than 6 square feet of paint per area, and housing declared direct free by a certified lead inspector.

 Kinds of properties affected by the program comprise pre-1978 schools, daycare centers, residential houses, and apartment buildings. *Currently painters, electricians, GCs, carpenters, home managers, and maintenance contractors are being required to supply pre-renovation educational lead pamphlets to tenants, receive delivery confirmation, and post signs concerning the office.Effective April 22, 2010, renovators have to attend an aviation training course with an EPA approved training provider as well as the firms they work for must also be accredited. 

 Training courses tackle debris and dust containment, restricting open fire burning, exhaust management for power tools and cleanup procedures, record keeping, and other precautionary measures. The certification must be renewed every five decades. Other local and state conditions may also apply and be more stringent.Insurance Issues While builders always have a Pollution vulnerability, the new EPA needs increase the risk for Pollution liability claims. 

 The rule requires renovators to perform lead testing, encapsulation, and cleaning tasks. Additionally, it requires the contractor to instruct real estate owners/residents about the risks of lead and the job to be done.A typical ISO GL policy generally excludes any purposeful Pollution policy under exclusion"F" in the coverage form. Most often a standard provider will endorse an absolute pollution exclusion where they perceive heightened exposures. Stand Contractors Pollution Liability (CPL) policies are offered for renovation contractors. 

 The policy provides third party bodily injury/property harm, protection, and remediation clean up policy for their contracting operations.Many surplus and surplus lines insurance companies are providing on both a claims made and occurrence basis. Minimum policy limitations generally start at $1 million with premiums at the $2,500 - $4,000 range. Even though the intent of this policy may be the very same, coverage can vary tremendously between carriers. 

 Make sure you get a specimen policy when deciding which policy to purchase.Renovation contractors should not only be conscious of the recent EPA regulations, but also how their changes in operations affect their present insurance plans.
