As every country has its own rules and regulations, the UK has its own unique procedure for marriages and civil partnership. This procedure differs from solemnizing marriage in India, which does not mandatorily require “giving notice”.
As an NRI or non-resident, you need to have an unmarried certificate. This certificate is called the Certificate of No Impediment (CNI) to Marriage there. If you don’t have it, get it from the Indian embassy prior to 29 days of marriage. Alternatively, you can directly get this single status certificate from the court and get it apostilled from the Ministry of External Affairs (MEA) through an expert agency. Ensure that your agent should be authorised for NRIs’ attestation services.
Eligibility for Marriage in the UK
Before thinking about wedding there, you should keep these facts into account:
Its law allows a civil partnership or marriage if you’re:
• 16 plus years old
• Unmarried or not in a civil partnership
• Not closely related
• Need permission from parents via single status affidavit (from Indian parents/guardians) if you’re under 18
• Apply for a visa to get married
The visa or permit will be provided upon knowing where your partner is from and whether you want to live in the UK after your matrimony.
Types of Visas
Here are the types of visas that you can apply for beforehand:
• A marriage visitor visa if you want to stay less than six months there
• A family visa if you want to shift there permanently after the marriage and your spouse is British
• A family permit if your spouse is not a British citizen
If you don’t have marriage visitor or family visa, there is still a scope to give notice of your intention for matrimony. You need to foretell the embassy or the Home Office. This authority will carry out a procedure for verifying your intentions.
The home office may ask these things:
• Who you’re and how your relationship built up
• Reject approval on your notice if it gets no satisfied answer.
What documents you need for “Giving Notice”
It is compulsory to bring original documents when your appointment is fixed.
Here is the checklist of those documents:
• Details of the final venue for your marriage ceremony
• A valid passport
• National identity card if you have
• Detailed address proof (India), which can be your parents’ or friend’s address
• A copy of deed poll-a proof of any name changes
• A passport sized photo for each of you (even if only one of you is from outside the European Union
• Proof of your current immigration status (or, your visa)
• A translation of any documents that are not in English
For address proof, non-residents can bring any of these to verify with the authority:
• A valid UK, EU, EEA or Swiss driving licence
• Utility bill from the last 3 months
• Bank or building society statement from the last month
• Council Tax bill from the last 12 months
• Mortgage statement from the last 12 months
• Current tenancy agreement
• letter from your landlord (dated within the last 7 days) stating that you live there together with your landlord’s name, address and their signature
For those who are likely to solemnize marriage again, they need any of these:
• A decree absolute or final order ( divorced spouse)
• Former partner’s death certificate
This verification will allow you to solemnize wedding in 12 months. Afterwards, it won’t be valid. You have to go through the entire procedure of verification right from the scratch. Keep these facts into account.
The non-availability of birth certificate is an alternative of the birth certificate.
